Biography

YEMBA OLELA Yannick is a lawyer registered at the Court of Appeal of Kinshasa/Matete in the Democratic Republic of Congo ("DRC") since 2014.

He works for Pathy Liongo & Associates, SCP ("PLA"), an international African law firm with offices in the Democratic Republic of Congo (Kinshasa, Matadi, Lubumbashi), South Africa (Johannesburg), Republic of Congo (Brazzaville), a member of the Lex Africa network.

He has been a trainer in OHADA recovery law at the Federation of Enterprises of Congo and at the Belgian-Congolese and Luxembourg Chamber of Commerce of Kinshasa since 2019. He is also the author of several books in the field of business law, including: (1) Practice of attachment of debts and attribution of outstanding debts: OHADA procedural incident, Kinshasa, SDE, 2019; (2) The execution of OHADA decisions and the defences to be executed in the light of Article 76 of the CPC: Illustrated procedure, Lyon (France), CERDAF editions, 2021.

As a practicing lawyer, he reconciles, postulates, advises, assists and represents national and international clients under public or private law in the field of business law, mining law, banking law, finance, finance, infrastructure, environmental, trade, investment, aeronautics, public procurement, information technology and telecommunications, and digital law.

In this case, he advises and assists clients in various proceedings before the Common Court of Justice and Arbitration of OHADA and the courts and tribunals of the Democratic Republic of Congo in civil, commercial, labor matters, securities, recovery litigation, credit file building, litigation of taking to task and referral of jurisdiction to the Court of Cassation.

He accompanies and assists clients in various proceedings before arbitral tribunals, represents them in the general meetings of public and private companies, drafts the minutes of the general meetings as a session secretary.

He brings his experience with clients in several finance and investment transactions, in due diligence projects for the acquisition and/or issuance of mining and quarry titles and in obtaining the administrative authorizations required to operate in the mining sector, for the acquisition of shares in companies and the obtaining of operating licenses in the electricity sector, telecommunications and subcontracting. He also advises credit and microfinance institutions and financial messaging in accordance with the legislative and regulatory framework applicable in the DRC.

He offers his services to credit institutions in the context of legal audits of securities or guarantees, collection and corporate law cases.

He holds a degree (Bac + 5) in law from the University of Kinshasa.

He is fluent in French and English and works in both languages.
